Terms and conditions of purchase and service

Last updated: October 17, 2026

1. About DATEK and to whom these terms apply

DATEK Data & Tekniksystem i Malmö AB, corporate identity number 556495-0581, offers technical service and products to companies, government agencies, and organizations. Sales are directed toward customers purchasing for their business operations and not to private individuals purchasing for private use. The person placing the order must be authorized to represent the customer.

These terms and conditions apply when they are included in the agreement between DATEK and the customer. A specific agreement, framework agreement, call-off, or other explicit agreement shall take precedence in parts where the terms differ. This also applies to specially agreed terms for government agencies and other public sector customers.

2. Inquiries, quotes, and orders

A contact inquiry or request for a quote does not in itself constitute an order. The scope, price, and terms for the assignment or purchase shall be stated in the parties' agreement.

For product orders via the website, the product description and the ordering, pricing, and delivery information presented for the purchase apply. The customer must be able to access applicable terms before completing the order. An automatic receipt confirmation shall be distinguished from an order confirmation, which implies that an order has been accepted; this shall be stated in the respective message and ordering flow.

3. Prices and payment

All prices are stated excluding VAT. Applicable VAT will be added. Currency, payment methods, and payment terms are stated in the quote, order, or other agreement. Any shipping costs and other charges shall be stated before the order is placed.

For services, the parties shall clarify whether the work is performed at a fixed price or on a time-and-materials basis, as well as what applies to troubleshooting, spare parts, travel, and travel time. Additional work or costs outside the agreed scope shall be coordinated with the customer before they are incurred.

The customer shall provide correct invoice details, order references, and any requirements for e-invoicing. In case of questions or objections regarding the invoice, the customer shall contact DATEK so that the matter can be investigated. Payment liability and any penalties are assessed in accordance with the agreement and applicable law.

4. Service assignments and customer cooperation

DATEK performs troubleshooting, maintenance, repair, and other technical services according to the agreed scope. Time, location, priority, and any response or arrival time are agreed upon for the assignment. An agreement on arrival time does not in itself mean that the equipment can be restored within the same timeframe.

The customer shall provide relevant information about the equipment and the fault, and arrange for agreed access, entry, and information regarding local safety requirements. If conditions change or the assignment needs to be expanded, the parties shall coordinate further work and any costs.

Before work that may affect data, settings, or software, the parties shall clarify the need for backup and who is responsible for it. Permissions and login credentials shall be handled in an agreed-upon secure manner. Specific requirements for confidentiality, information security, and processing of the customer's personal data are regulated in the assignment.

5. Products and delivery

Product, quantity, specification, and any warranty are stated in the order. Delivery method, delivery address, shipping cost, and delivery time are specified for the current purchase. An estimated delivery time shall be distinguished from a specifically agreed binding delivery time.

In case of delivery issues, the customer shall contact DATEK for information and handling in accordance with the agreement and applicable law. The customer should inspect the delivery and document visible damage or discrepancies as soon as possible. Keep packaging and other relevant documentation in the event of transport damage.

6. Complaints regarding products and services

Contact DATEK when a fault or discrepancy is discovered. State the order or assignment number, which product or equipment the matter concerns, and a description of the fault. Please attach relevant images or error messages.

Complaints shall be made within the time specified by the agreement and applicable law. For goods purchases where the Sale of Goods Act applies, this generally means that the customer must file a complaint within a reasonable time after the fault was discovered or should have been discovered. Complaints regarding a service assignment are assessed based on the agreed assignment and applicable rules.

DATEK and the customer will coordinate how the fault is to be examined and remedied. Contact DATEK before equipment or products are sent back to receive instructions. This does not affect the rights provided by the agreement or applicable law.

7. Warranty

A warranty applies when such has been explicitly provided for the specific product or service. Scope, warranty period, warrantor, and handling shall be stated in the warranty terms. A warranty does not limit other rights that the customer has under the agreement or applicable law.

8. Returns and cancellation of product orders

DATEK only accepts returns of defective goods within 14 calendar days from the delivery of the concerned item. Returns of non-defective goods, returns for money back ("öppet köp"), and exchanges are not offered.

The customer shall contact DATEK at info@datek.se within this timeframe, providing the order number, delivery date, and a description of the fault. Contact DATEK for assessment and return instructions before the item is sent back. A return request does not automatically imply a right to a refund; the handling is determined after assessment of the fault and in accordance with the agreement.

Product orders cannot be cancelled after the customer has placed the order.

The return deadline above regulates DATEK's return handling and does not mean that an explicitly provided warranty or other rights under a special agreement or mandatory law expire after 14 days. Complaints are handled according to section 6 and warranties according to section 7. For service assignments, agreed terms for changes and cancellations apply.

Purchases for business purposes are not covered by the statutory right of withdrawal for consumers.

9. Liability and disputes

The parties' liability is assessed in accordance with the special agreement, these terms, and applicable law. Any special limitations of liability must be explicitly agreed upon.

In case of disagreement, the customer shall contact DATEK so that the parties can attempt to resolve the issue. If the parties do not reach an agreement, the dispute is handled in the agreed manner or otherwise according to applicable rules.

10. Personal data

Information regarding DATEK's processing of personal data is available in our privacy policy. If DATEK processes personal data on the customer's behalf in a service assignment, the parties shall regulate this when necessary, for example, through a data processing agreement.
