DATEK provides technical service and offers products to companies, government agencies, and organizations. The policy applies to personal data regarding contact persons at these organizations, other individuals who contact us, and visitors to our website. Contact details for a named professional contact may constitute personal data even when the customer is an organization.

What data we process and where it comes from

We process the data necessary for the current contact or business relationship. This may include name, professional role, organization, e-mail address, telephone number, billing and delivery address, as well as information in inquiries, quotes, orders, service requests, and other correspondence.

The data usually comes from you or your organization. Professional contact details may also be collected from publicly available sources on the internet, such as company websites. Such data may include both general company addresses and addresses for specific contact persons.

When you visit the website, technical data may be processed, such as IP address, browser, device information, and how the website is used. Which data is processed depends on the functions used and your cookie choices.

Purpose and legal basis

  • Inquiries, quotes, and customer contact: We process data to answer questions, provide quotes, and communicate with you. For contact persons at organizational customers, the processing is based on our legitimate interest in managing relevant business contacts, following a balancing of interests.
  • Service and product orders: We process data to plan and carry out assignments and to manage orders, delivery, payment, and complaints. When you represent an organization, the processing is based on our legitimate interest in administering and fulfilling the business relationship. If you are a party to the contract yourself, for example as a sole trader, the processing may be necessary to enter into or fulfill the contract with you.
  • Accounting and other legal requirements: Data necessary to fulfill legal obligations is processed based on legal obligation.
  • Newsletters and direct marketing: Professional information about our products and services may be directed to customers and relevant business contacts. The processing is based on consent or, where permitted and following a balancing of interests, our legitimate interest in marketing our business. We also follow the specific rules that apply to electronic marketing. A public e-mail address does not in itself constitute consent to receive mailings.
  • Website function and security: Necessary technical processing is based on our legitimate interest in providing a functional and secure website. Optional cookies for statistics or marketing are used with your consent when required.

When we rely on legitimate interest, we weigh the needs of the business against your interest in the protection of your personal data. You can contact us for more information about the assessment.

Newsletters and the option to opt-out

DATEK writes its newsletters and sends them via Microsoft 365. Each newsletter must contain a clear and free option to opt out of future mailings. You can also contact info@datek.se.

You have the right to object to your personal data being used for direct marketing at any time. We will then cease such use. We may retain the limited information necessary to respect your choice and avoid adding you to mailings again. Messages required for an ongoing assignment, order, or legal obligation are handled separately.

Systems, suppliers, and other recipients

Personal data may be processed in the following systems and services:

  • Fortnox: storage and management of customer information within our administration.
  • Microsoft 365: e-mail, customer communication, and our internally produced newsletters.
  • Shopify: operation of the website and management of the ordering functions used.
  • Google Analytics: statistics on website usage when the service is activated and required consent has been provided.

LinkedIn is a planned channel for advertising. When you interact with DATEK's ads or company page on LinkedIn, LinkedIn may process personal data according to its own privacy policy. If additional tracking or target audience functions are introduced on DATEK's website, information and consent management will be adapted before the functions are used.

When product sales or other services require it, relevant data may be provided to payment, transport, or other service providers to fulfill the order. The providers used are stated in the current order or supplementary information. Data may also be provided to authorities when required by law or to advisors when necessary to assert legal claims.

Suppliers may process data on our behalf as data processors, or in some cases as independent data controllers for their own purposes. Information about the suppliers' processing can be found at Fortnox, Microsoft, Shopify, Google, and LinkedIn.

Relationship with Shopify

The services are provided by Shopify, which collects and processes personal data about your access to and use of the services for the purpose of providing and improving the services for you. Information that you provide to the services will be transferred to and shared with Shopify and third parties who may be located in countries other than the country where you reside, for the purpose of providing and improving the services for you. To protect, develop, and improve our business, we also use certain advanced features from Shopify that contain data and information obtained from your interactions with our store, other merchants, and Shopify. In order to provide these enhanced features, Shopify may use personal data collected about your interactions with our store, other merchants, and Shopify. In these circumstances, Shopify is responsible for the processing of your personal data, including for responding to your requests to exercise your rights regarding the use of your personal data for these purposes. For more information about how Shopify uses your personal data and what rights you have, you can visit Shopify's Privacy Policy for consumers. Depending on where you live, you can exercise certain rights regarding your personal data here. Link to Shopify's Privacy Portal.

Processing outside the EU/EEA

Some of our suppliers operate internationally. Data may therefore be processed outside the EU/EEA. For such transfers, there must be support according to data protection rules, such as a decision from the European Commission on an adequate level of protection or standard contractual clauses with necessary supplementary protective measures. The suppliers' applicable data protection agreements describe their transfers and protections. Contact us if you want more information about what applies to your data and how you can access relevant protective measures.

How long the data is saved

We do not store personal data longer than is necessary for the purpose. The assessment is based on the type of data, the current contact, and the applicable obligations:

  • Inquiries and quotes: as long as necessary to handle the matter and for reasonable follow-up. Data that needs to be saved for a subsequent order is handled within the customer relationship.
  • Customer data, orders, and service history: during the business relationship and thereafter to the extent that the data is needed for, e.g., service follow-up, complaints, warranty, or legal claims. Contact details should be corrected or deleted when they are no longer needed.
  • Accounting records: as long as required according to accounting rules.
  • Marketing data: as long as there is a valid basis and the data is needed for the purpose. Upon unsubscription or objection, use for direct marketing ceases; a limited blocking entry may be retained to respect your choice.
  • Technical data and cookies: according to the purpose and retention period of the current function. More detailed information about active cookies is provided in the website's cookie information.

Your rights

You can request access to your personal data and have incorrect data corrected. You can also request deletion, restriction, or data portability, as well as object to processing, to the extent that the rights apply to the current processing. For processing based on legitimate interest, you may object based on your specific situation. The right to object to direct marketing always applies.

If processing is based on consent, you can withdraw it at any time. The withdrawal does not affect the legality of the processing that has already taken place. To exercise your rights, contact info@datek.se. We may need to verify your identity to protect the data.

You have the right to lodge a complaint with the Swedish Authority for Privacy Protection (IMY) if you believe that your personal data is being processed incorrectly.

Cookies and your choices

You can accept or decline optional cookies in the website's consent banner. You can also delete cookies for the website in your browser to make a new choice when the consent banner appears again. You can block cookies in your browser, but some features may then be affected. Also read our cookie information.

Data in equipment being serviced

This policy describes DATEK's processing for our own purposes. If an assignment implies that we process personal data on behalf of the customer, the responsibilities and instructions need to be regulated in the assignment and, where required, in a data processing agreement.

Contact and changes

Contact info@datek.se if you have questions about the policy or our processing of personal data. The policy is updated when the business, services, or processing change. The latest update date is indicated at the top.
